1. Purpose and Scope of the Terms

These Terms of Use ("Terms") govern the use of:

Forair's websites, namely forair.ca, amiral.eco and projetamiral.ca (the "websites")
the Forair application, accessible at app.forair.ca (the "Forair application")

By accessing the websites or the Forair application, you agree to these Terms and to our Privacy Policy. If you do not agree with any of these provisions, you must stop using our services.

The Privacy Policy describes how we collect, use, disclose, retain and protect personal information in accordance with applicable laws, including the Act Respecting the Protection of Personal Information in the Private Sector (Law 25). In the event of any inconsistency between these Terms and the Privacy Policy, the Privacy Policy prevails.

We may update these Terms at any time. By continuing to use the websites or the Forair application after an update, you agree to the revised Terms.

In the event of any inconsistency between linguistic versions of these Terms, the French version prevails. The masculine form is used solely to simplify the text and includes the feminine.

2. Types of Users

Depending on how you use our services, you may be:

a website visitor
a basic user, when you use the Forair application without a subscription or with limited features
a subscription holder, when you use the application under a subscription held by you or your organization
a managed user, when your access and permissions within the Forair application are granted and administered by an organization or a third party

All users of the Forair application may access à la carte services when offered. These services may be billed separately according to the terms provided at the time of purchase.

3. Use of the Websites

The websites allow you to consult information about Forair, complete forms, subscribe to a newsletter and access informational content. You must use the websites in a lawful and respectful manner. The websites may contain links to third-party sites. Forair is not responsible for their content or practices.

The processing of personal information collected on the websites, including through cookies or analytics tools, is governed by the Privacy Policy.

4. Use of the Forair Application

4.1 Account Creation and Management

To use the Forair application, you must create an account and provide accurate and up-to-date information. You are responsible for maintaining the confidentiality of your password and for all activities conducted through your account. If you suspect unauthorized access, you must contact us at app@forair.ca.

Personal information provided when creating and using your account is processed in accordance with the Privacy Policy.

4.2 Basic Users, Subscription Holders and Managed Users

Basic users: you may use the Forair application with a limited set of features.
Subscription holders: you use the application under a subscription held by you or your organization. You have access to the features included in that subscription.
Managed users: your access is provided by an organization or third party that holds the subscription (the "client"). The client determines permissions, retention rules, sharing settings and access rights. In the event of a dispute between you and the client, Forair will not intervene unless legally required.

4.3 Payments and Billing

When you purchase a subscription or an à la carte service within the Forair application, payment is processed securely by a payment service provider. Forair never has access to the full details of your payment card. You must provide accurate information and be authorized to use the selected payment method.

Prices, taxes and applicable terms are displayed at the time of purchase. Unless otherwise stated, fees paid are non-refundable. In the event of a failed or fraudulent payment, Forair may suspend access to the affected services.

5. Eligibility

To use our services, you must be at least sixteen (16) years old and legally able to enter into a contract under applicable laws. If a higher age is required in your region for us to process your personal information without parental consent, you must meet that requirement.

6. License of Use

Subject to compliance with these Terms, Forair grants you a personal, limited, non-exclusive, non-transferable and revocable right to use the websites and the Forair application for your internal needs or those of the organization that authorizes you.

7. Acceptable Use

You are prohibited from:

attempting to access unauthorized areas or systems
bypassing or interfering with our systems
conducting fraudulent, illegal or deceptive activities
publishing defamatory, hateful, violent or illegal content
publishing sensitive personal information without proper authorization
sending unsolicited messages or spam
using the services in a way that harms Forair or third parties
using the services to design a competing product

If you use analytics or automated assistance features, you remain fully responsible for all decisions made and must always exercise human judgment.

Forair may suspend or terminate an account in case of non-compliance with these Terms.

8. Content Submitted in the Forair Application

Basic users and subscription holders: you retain ownership of the content you create or import in the application. You authorize Forair to use it solely to provide, maintain and improve its services.
Managed users: content created or imported in the application is controlled by the client who grants you access. The client determines access, sharing, retention and deletion rules.

Any comments or suggestions you submit to Forair may be used freely and without compensation.

You are responsible for the content you submit and represent that you have the rights necessary to publish or import it.

9. Intellectual Property

Forair retains all intellectual property rights related to the websites, the Forair application, technologies, text, data models, features and graphical elements. No ownership rights are transferred to you.

10. Warranty and Limitation of Liability

The services are provided "as is," without guarantees regarding continuous availability, absence of errors or absolute security.

To the extent permitted by law, Forair is not liable for indirect, incidental or consequential damages. Forair's total liability to you is limited to one hundred (100) dollars.

Nothing in these Terms limits your rights under mandatory laws, including those provided by Loi 25.

11. Promotional Communications

Consent to receive newsletters or promotional communications is collected separately and is never required to use the websites or the Forair application.

You may withdraw your consent at any time by using the link in our emails, adjusting your account settings, or contacting us at the address provided in the Privacy Policy.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of Québec and Canada.

Before initiating legal proceedings, you must contact us at info@forair.ca to attempt to resolve the dispute in good faith.
