Privacy Policy

1. Introduction

Protecting your personal information is a priority for Forair Inc. ("Forair"). This policy explains, in a clear and transparent manner, how we collect, use, disclose, retain, and protect personal information when you use our websites (forair.ca, amiral.eco, projetamiral.ca) or the Forair application (app.forair.ca), in accordance with applicable laws, including the Act Respecting the Protection of Personal Information in the Private Sector (Loi 25).

By accessing our services, you agree to the practices described in this policy. It may be updated at any time to reflect changes in our practices or legal obligations, and the current version is always available on our websites.

2. Personal Information Collected

2.1 Use of the Websites

When you visit our websites, we collect browsing data such as your IP address, device type, pages viewed, date and time of your visit, and language preferences. This information is used to ensure the security of the websites, measure traffic, and improve your browsing experience.

When you fill out a form—such as to contact us or subscribe to a newsletter—we collect the personal information required to process your request, such as your name, contact details, email address, or any document you choose to upload.

2.2 Use of the Forair Application

When you create an account and use the Forair application, we collect the information necessary to identify you, validate the ownership of your lots, provide access to the features available to you, secure your account, and ensure the proper functioning of the application.

To improve the application, we also use analytics tools such as Microsoft Clarity and Google Analytics, which anonymously or pseudonymously observe how you interact with the interface, including the sections you view, elements you click on, or areas where usability issues occur. These tools are used solely to understand how the application performs and to improve its performance, stability, and usability. They do not provide us with personally identifiable information, except when you voluntarily enter such information in a designated input field.

2.3 Payments

When you make a purchase within the Forair application, we collect the information necessary to process the transaction, such as your contact details and purchase details. Payment card information is never stored by Forair and is transmitted directly to our payment processor, which handles it in accordance with strict security and compliance standards.

We retain limited information about your transactions—such as the date, type of purchase, amount, and payment status—to manage your services, provide support, and fulfill our legal obligations.

3. Cookies and Analytics Tools

3.1 Cookies Used on the Websites

Our websites use essential cookies that ensure their operation and security. With your consent, we may also activate optional cookies used to measure performance, analyze traffic, or personalize certain content. You may modify your cookie preferences at any time through our cookie management banner.

3.2 Cookies and Analytics Tools Used in the Forair Application

The Forair application uses cookies and analytics tools to function properly and to support continuous improvement. Essential cookies keep your session active, authenticate your identity, protect your account, and ensure data security. These cookies cannot be disabled, as they are required for the secure operation of the application. Functional cookies may also be used to save your preferences—such as language, display settings, or filters—to simplify your experience and avoid repetitive configurations.

The application also uses integrated analytics tools, including Microsoft Clarity and Google Analytics, to understand user paths, identify drop-off points, improve validation processes, detect areas where difficulties may occur, and prioritize necessary improvements. The data processed for this purpose is anonymized or pseudonymized and is not used to identify you directly or indirectly.

Unlike advertising cookies used on some websites, no advertising cookies are used in the Forair application.

4. Use of Personal Information

We use your information to manage your account, provide the services and features you request, process your communications, analyze usage of our platforms, secure our systems, personalize your experience, develop and improve our services, process payments when you make a transaction, and comply with legal obligations. We may also use de-identified data for internal analysis or to improve service quality.

5. Hosting and Disclosure of Personal Information

Your personal information is stored in a database owned by Forair, a company located in the province of Québec, Canada. It is hosted in the Canada Central region of Amazon Web Services (AWS), whose data centers are primarily located in the Montréal area. Hosting within Canada ensures that your personal information remains subject to Canadian and Québec privacy laws.

Your personal information may be shared with certain service providers who assist us with our operations, including hosting, payment processing, email sending, technical services, or performance analytics. These providers must protect your information under strict contractual obligations. Forair does not sell or rent your personal information. We disclose it only when necessary to provide our services or when required by law.

6. Retention, Security and Destruction

We retain your personal information only for as long as necessary to fulfill the purposes for which it was collected or to meet our legal obligations. Once these purposes are met, the information is destroyed or anonymized irreversibly.

We apply administrative, technical and physical safeguards to protect your information, including encryption, access controls, the exclusive use of secure servers, and continuous system monitoring. Despite these measures, no method is entirely free of risk. If you believe an incident may have compromised your information, please contact us immediately.

7. Your Rights

You may request access to the personal information we hold about you, as well as the correction of any information that is incomplete, inaccurate, or unclear. When our processing is based on your consent, you may withdraw that consent at any time. You may also request the portability of certain computerized information in a structured and commonly used format, or request that we cease disseminating specific information or de-index it when permitted by law.

If a decision that affects you is made solely through automated processing, you may request an explanation of that decision and obtain a human review. All such requests must be addressed to Forair's officer responsible for the protection of personal information.

8. Privacy Incidents and Governance

In the event of an incident presenting a serious risk of harm, Forair follows the measures required by law, including risk assessment, notifying Quebec's Commission d'accès à l'information, notifying affected individuals, and recording the incident in the mandatory registry. We have also implemented internal rules governing the collection, use, retention and destruction of personal information, and we conduct privacy impact assessments when a project presents particular risks.
